The European Commission will analyze the Polish law on the suspension of the right to asylum when the legislative process of this regulation is completed. We cannot comment on legislation that has not yet been adopted – admitted on Friday EC spokesperson Markus Lammert during a briefing in Brussels.
Prime Minister Donald Tusk appealed to President Andrzej Duda for the fastest possible signing of the law limiting the right to asylum.
The EC was asked on Friday whether this Polish law is contrary to the EU Charter of Fundamental Rights and whether the Commission will take action if the Polish president signs this law.
“The Commission is aware of recent developments in the Polish parliament regarding this new law. But of course we cannot comment on legislation that has not yet been adopted,” said Lammert, adding that the EC will analyze the law after its legislative process is completed.
He also emphasized that in the case of Poland, it is crucial to “remind the context”. “There are hybrid threats resulting from the use of migration as a weapon by Russia, with the support of Belarus. They pose a risk to the sovereignty, national security, and territorial integrity of Poland, as well as the security of the Union as a whole,” stressed the spokesman.
The amendment to the law on granting protection to foreigners on the territory of the Republic of Poland provides for the possibility of introducing a temporary, territorial restriction on the right to asylum. The restriction on the right to submit an application for international protection may be introduced by a regulation of the Council of Ministers at the request of the Minister of Internal Affairs and Administration.
It should take into account “the need to prevent the destabilization of the internal situation” in the country and aim at “minimizing the restriction of the rights of foreigners intending to apply for international protection”. According to the amendment, the restriction will be temporary, and the period of validity of the restriction cannot exceed 60 days at a time. This period may be extended for a specified time.
