The Commission does not want to comment at this time on whether the border controls announced by Germany are necessary and proportionate. This is still being assessed. The Commission also does not want to say what actions it will take if it is determined that Germany is acting in violation of the Schengen Code.
On Monday, the Dutch PVV Minister Marjolein Faber (Migration) stated that she is closely monitoring the implementation of the German border controls with interest. PVV leader Geert Wilders supports border controls. “As far as I’m concerned: the sooner, the better,” he said on Tuesday. He wants to see if the Dutch government can take a similar measure.
The Schengen Code contains the rules for the border control of persons entering a member state through the external borders of the EU member states.
“According to the Schengen Borders Code, Member States may reintroduce internal border controls to address a serious threat, either to public order or internal security when necessary,” said the spokesperson.
If other Member States also want to introduce border controls, this must be in accordance with the Schengen Borders Code according to the Commission.
